Question 2 Notes – Wholly Obtained (WO):

The following defines what raw materials are considered to originate from New Zealand under the Wholly Obtained criteria:

1. Plant products harvested, picked or gathered in the territory of New Zealand.
2. Live animals born and raised in the territory of New Zealand.
3. Goods obtained from live animals raised in the territory of New Zealand.
4. Goods obtained from hunting, trapping, fishing, farming, gathering or capturing conducted in the territory of New Zealand.
5. Minerals and other naturally occurring substances, not included in paragraphs (a) to (d) above, extracted or taken from New Zealand soil, waters, seabed or beneath its seabed.
6. Goods extracted or taken by a Party, or a person of a Party, from the waters, seabed or subsoil beneath the seabed outside the territorial waters of New Zealand or China, provided that the Party has the right to exploit such waters, seabed or subsoil beneath the seabed under New Zealand or China’s applicable domestic law in accordance with relevant international agreements to which that Party is a party.
7. Goods (fish, shellfish, plant and other marine life) taken within the territorial waters or the Exclusive Economic Zone of New Zealand or China seaward of the territorial sea under New Zealand or China’s applicable laws in accordance with relevant international agreements to which that New Zealand is a party, or taken from the high seas, by a vessel registered or recorded with New Zealand or China and flying or entitled to fly the flag of New Zealand or China.
8. Goods processed and/or made on board factory ships registered or recorded with New Zealand or China and flying or entitled to fly the flag of New Zealand or China, exclusively from goods referred to in paragraph (g) above.
9. Scrap and waste derived from processing operations in the territory of New Zealand and fit only for the recovery of raw materials, or used goods collected in the territory of New Zealand provided that such goods are fit only for the recovery of raw materials.
10. Goods obtained or produced in the territory of New Zealand solely from goods referred to in paragraphs (a) to (i) above.
